NOTES






1 -- Lewis Nicola was commissioned an Ensign in 1740, Lieutenant in 1745, Fort Major of Charles Fort in Kinsale from 1754, quit the Army in 1766 and emigrated with his family to America, embarking 28 May 1766 on the Speedwell and arriving in Philadelphia on 29 Aug. 1766. He was one of the founders of the American Philosophical Society (April 1768), and publisher of the Transactions of this Society. In 1769 he was founder of the General Circulating Library. At the outbreak of the War for American Independence (the American Revolution) in 1776, he was made barrack master of Philadelphia, and then Town Major 1776-1782. He wrote A Treatise of Military Exercise and translated Clairac's L'Ingenieur de Campagne, both published in 1776, and in 1777 he translated Grandmaison's Treatise on Military Service. He was founder of the Corps of Invalids (the home defense portions of which are now the National Guard, and the training portions of which are now the US Military Academy at West Point) and appointed by the Continental Congress as its first Colonel on 20 June 1777. He was brevetted a brigadier general on 4 Nov. 1783, and was a founding member of the Society of the Cincinnati. He retired from Continental Service in Dec. 1784. He is mostly remembered for his proposal (May 1782) to Gen. George Washington that a change of government to a Monarchy was in order, and that Washington should become King, and also for Washington's stern rebuke to Nicola dated Newburgh 22 May 1782: "I must view [this suggestion] with abhorrence and reprehend with severety." The Act of Congress of 3 March 1863, authorizing the suspension, said that the suspension was in force "during the present rebellion" (i.e., the Civil War). On 5 July 1865, Justice Thompson, of the Supreme Court of Pennsylvania, ruled that the rebellion was at an end, that the president no longer had the power to suspend habeas corpus, and ordered Cozzens released. FURTHER NOTES






There is currently [2009] no tombstone in the graveyard of the Old Presbyterian Meeting House, (323 South Fairfax St., Alexandria, VA 22314 703-549-6670) to show where Col. Nicola was buried.

It is possible (the evidence is suggestive but not determinative) that Col. Nicola's body was the otherwise unidentified body which was unearthed in 1826 clothed in a Revolutionary War uniform, and then reinterred, and whose gravesite was dedicated in 1929 as the "Tomb of the Unknown Soldier of the American Revolution". See, for example, T. Michael Miller, Artisans and Merchants of Alexandria, Virginia 1780-1820 [1992], vol. 2, p. 391.
