In Search Of ... Kathleen



There is a company located in Bothell, Wash., named Receivables Performance Management, or "RPM". Their website is http://www.receivablesperformance.com. They're debt collectors -- if a person skips out on a debt to a company, that company sells the debt to RPM, which then pursues payment from that person.

Apparently sometime shortly before late August 2007, a company sold a debt of someone named something like "Kathleen Adams" (spelling approximate) to RPM, RPM decided that this "Kathleen Adams" was reachable through one of my home telephone numbers, and on 28 August 2007 started attempting to collect on that debt by calling that number of mine.

The only problem with this is that I don't know anyone named anything like "Kathleen Adams". Ooops.

No matter, RPM's sterling research techniques had tracked this "Kathleen" to my number, so RPM called my number pretty much every single day. What you see below is a diary of RPM's calls to that phone number of mine, trying to reach this "Kathleen Adams". I let my answering machine handle almost all of the calls.




RPM is a corporation (specifically an LLC) registered in Washington State. Its Washington State UBI number (that's "Unified Business Identifier") is 602226604. As of late 2007, RPM's Registered Agent is

In addition to whatever applicable State laws there may be, RPM is required to follow the terms of federal legislation, such as the Fair Debt Collection Practices Act (FDCPA), 15 USC 1692 et seq.

Violations of the FDCPA are punishable by damages of up to $1000 per violation [1692k section (a)(2)(A)]. However there is a part of the FDCPA, at 1692k section (c), which says that damages are not recoverable if the debt collection agency can show that its violation(s) were the result(s) of an error which occurred in good faith ("bona fides"). Because of this, cases like mine, where I am not a debtor but instead am an innocent bystander splattered by the misguided zealousness of a debt collection agency run amok, my damages (if any) are most likely unrecoverable.

Note that it is the debt collection agency (such as RPM) which is bound by the terms of the FDCPA; the debtor is not. The closest the FDCPA gets to requiring an action on the part of the debtor is when the FDCPA states that if the debtor takes action "A" then the debt collection agency must respond in a certain way, while if the debtor instead takes action "B" then the debt collection agency must respond in a different way, but the FDCPA does not require any action on the part of the debtor. Uninvolved third parties, such as myself, are not even mentioned.

Some folks reading this may claim that I have some sort of duty to help RPM correct their error. Apart from the complete absence of any statutory requirement that I provide such help, anecdotal evidence (see here and here and here and here) suggests that RPM won't stop calling wrong numbers.

Several of these anecdotal sites state that if you call one or another of the toll-free numbers that RPM uses, you will be presented with a menu which says something like "Press 2 if you're not that person". This is not true. If you call their toll-free number(s) from a pay phone (as I have), you get a generic "Hello, this is RPM, please wait for the next available representative" message. Presumably what happens is RPM captures the phone number on each incoming call and compares it to their database. If the number that you're calling from is in their database, you get a personalized message, and if it isn't then you get a generic message. I haven't phoned RPM from my number, the number on which they're calling for "Kathleen".

So why haven't I availed myself of this service, to try to get RPM to stop calling my number looking for "Kathleen"? Well, for one reason, RPM is not calling me, they're calling "Kathleen". If "Kathleen" really exists, and wishes to call RPM, from my phone or from anywhere else, she's certainly welcome to do so.

But the main reason I haven't tried to call RPM to get them to stop is that this would be using a process designed by, built by, implemented by, administered by, maintained by, and operated by RPM staff, the same folks who started this whole mess in the first place by deciding that "Kathleen Adams" could be reached by calling my number. Based on that demonstration of RPM's skillset, their competence and carefulness, all I can say is "Thanks but no thanks".

Besides, their calls are nothing more than a minor nuisance. All they're doing is wasting their time, wasting their company's resources, filling up my answering machine and my CID display, and providing me (and now you) with some minor amusement. Of course, "Kathleen Adams", if such a person exists, may be annoyed at RPM for revealing her business to me, and thus to you (it's possible that RPM, a debt-collection agency, is aggressively trying to contact "Kathleen" for something other than an unpaid debt, such as offering her a job, but you tell me how likely that is), but that's between "Kathleen Adams" and RPM.

A word of caution if you're considering spoofing your telephone number while calling RPM: firms which use number-capturing technology on their incoming calls will usually ignore the CID value and instead use ANI.




Notice the terms by which RPM has defined the interaction between themselves and others: they will call and call and call and call. They will continue to call until they achieve their goal (whatever that goal might be). If it turns out that they're calling the wrong number, then they are relying on the person they are victimizing, the person who is receiving their mis-directed calls, to react in a certain way. That way is for the victim to *tell* RPM that RPM is calling the wrong number. RPM doesn't seem to have considered the possibility that the victim of their mis-directed calls might not mind being victimized in this way, and that the victim might even contrive to exacerbate the situation. Keep this in mind if you're ever victimized by mis-directed calls from a company which works in the way RPM appears to operate.




As for exacerbating the situation, there's always the option of answering one or more of the mis-directed phone calls, and, during the conversation with them, lying to them.

This point may not be well understood, but lying is not a crime. Lying may be dishonest, and a liar may suffer social opprobrium and/or business repercussions for lying, but there are no criminal penalties for lying unless there is a legal obligation to tell the truth, e.g.: Debt collectors aren't legal authorities or courts, and when you're interacting with a debt collector, even a debt collector who's an attorney, you aren't under oath :)




So let's see how far and how aggressively RPM will pursue this dead end. Let's also see how well my mis-direction (if any) works in revving up RPM. That, and building this webpage, are my reactions to RPM's reign of error.




As I said, I let my answering machine handle almost all of the calls from RPM. On Thursday 11 Oct 2007, for the first time, I answered the phone when RPM called (see below for details of the conversation). Note that I didn't volunteer any information, such as trying to explain to them that I had no idea who this "Kathleen" was, that they'd been calling the wrong number, pretty much every day, for about a month and a half, and that they were wasting their and my time in their futile pursuit. Other than that, I was completely honest with them :)

On Thursday 18 Oct 2007, the caller from RPM appeared to ask for someone different, a "Demini". This might be attributable to the poor diction of the caller.

On Monday 22 Oct 2007, I again answered the phone when RPM called (see below for details of the conversation). Again I volunteered no information, and again I was completely honest with them :)

You know how you place your hand over the mouthpiece of a telephone when you want to say something to someone nearby? Well, I did that during the conversation I had with the RPM person who called on Thursday 15 Nov 2007, even though I was completely alone in my home at the time. I didn't actually make any untrue statements (see below for details of the conversation), but I pretended that I was relaying information to Kathleen, and the RPM caller fell for it :)

I noticed that the tenor of the messages left by RPM on my answering machine changed after this conversation. Before they were phrased as requests, and afterwards they were phrased as instructions. Also the names used by the RPM callers were a different set of names. Perhaps RPM uses one group of employees to make the initial calls, and a different group of employees once RPM establishes that the person in question really can be reached at the number RPM has for the person, and my performance was good enough to persuade RPM to promote, as it were, their calls to "Kathleen" from the first group of employees to the second group. And perhaps not.

The RPM caller on 23 Nov 2007 asked for "Kathleen Demeeni, Domini, I'm sorry", as if he had accidentally mispronounced her name. Note that he didn't ask for "Kathleen Adams", as (most of) the other RPM callers had. Perhaps one of these names is her married name and the other is her maiden name, or perhaps RPM is looking for two completely different people at my telephone number, or perhaps the folks at RPM are just making the whole thing up as they go. I have no way of knowing.

The RPM caller on 27 Nov 2007 asked for "Demee Adams", yet another name variation.

The RPM caller on 14 Dec 2007 mentioned that he would be there [presumably at work] until 11:15, and that "Kathleen" should call him before then. Unfortunately he didn't say *which* 11:15 he would be there until (i.e., which time zone he's referring to), so "Kathleen" was unable to use the information.

It's reassuring to see that RPM staff is dedicated enough to come in and work on Christmas Eve, 24 Dec 2007, even though the RPM caller said he wanted to speak with "Katheen Adams", not "Kathleen Adams" as the other RPM callers said.

On 28 Dec 2007, RPM called me three times in a four-hour period, and didn't leave a message during any of the calls. It may be just a coincidence, but this is the four-month anniversary of the date RPM started calling my number.

The RPM caller on 29 Dec 2007 asked for "Kathleen Demmi Adams", yet another name variation.

On 20 Jan 2008, RPM expanded their arsenal of techniques by making a mechanical (i.e., pre-recorded) call. Presumably the calling device is linked into RPM's database, and when a personalization is needed ("Kathleen" in this case, "Joe" or "Bob" or "Sue" or whatever in other cases), some sort of voice-generating module is used.

On 21 Jan 2008, RPM apparently decided it would help them to assert that there's a difference between their call and a solicitation call (i.e., telemarketing).

On 23 Jan 2008, RPM apparently decided it would help them to remind "Kathleen" that they had a toll-free number.

On 27 Jan 2008, I uploaded this file to my website, and added the links to navigate to it. I will continue to update this page as appropriate.

By 2 Feb 2008, this webpage had been indexed by Google, which means that this page is now one of the links Google returns when you search for a character string on the page (such as "Receivables Performance" or "866-212-7408"). Let's see how long it'll take for someone to notice.

5 Feb 2008 is the first time an RPM caller uses the "ma'am" honorific when trying to address "Kathleen".

2 March 2008 -- RPM has now been calling my number for more than six months in their fruitless quest for "Kathleen". :)

The calls continue through at least 23 June 2008. At some point between 25 June 2008 and 1 October 2008, the calls stopped and have not (as of 4 July 2009) resumed. See below for details.

She said that her name was Thekla (she even spelled it), and asked for Kathleen to call her at 866-212-7408. Between 25.06.2008 and 01.10.2008, I was out of town, and had unplugged my Caller ID display and my answering machine. Because of this, no calls were logged during this time. However, once I had returned home and had plugged my Caller ID display and my answering machine back in, I found that the calls from RPM had stopped. As of 04.07.2009, they have not yet resumed.

Why their calls stopped is as much a mystery as why their calls started in the first place. Perhaps their policy is to call one number for only one year and then stop. Perhaps they found "Kathleen Adams" at some other location, and she provided them with what they were looking for her for. Perhaps they found this webpage, realized their error, and came to their senses. Perhaps they went out of business. I have no way of knowing.

This webpage will remain, as a monument to RPM's defective tactics, and as a resource for folks who are similarly victimized by RPM and other companies who act like RPM.
